No data protection officer has been appointed, as we are not legally required to do so (Art. 37 GDPR, § 38 BDSG).
This privacy policy applies to the website jappsd.de and to the apps M.E.L.C. and Train Sounds Effect. Separate privacy policies apply to Duke It Out, FiWo and Forgotten X (see section 5).
Our apps and this website contain no advertising, no tracking and no analytics services. We do not sell data.
Our servers (website, app interfaces, email) are operated on our behalf by STRATO GmbH, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany. STRATO uses its own sub-processors, in particular IONOS SE, Elgendorfer Straße 57, 56410 Montabaur, for server operations; STRATO publishes the current list at strato.de/agb/auftragsverarbeiter. The servers are located in data centres within the European Union. A data processing agreement pursuant to Art. 28 GDPR is in place with STRATO.
Legal basis: Art. 6(1)(b) and (f) GDPR.
Each time the website is accessed, our server automatically stores: IP address, date and time, requested page or file, amount of data transferred, status code, referrer URL, browser type and version and operating system. This is necessary to deliver the website, detect errors and fend off attacks. The log files are automatically deleted after 7 days and are not combined with other data.
Legal basis: Art. 6(1)(f) GDPR.
The website sets no cookies and uses no analytics or tracking services. Your language selection is kept in your browser's session storage (sessionStorage) for the duration of the session; this is technically necessary (§ 25(2) no. 2 TDDDG).
For the contact form, we process your name, email address, the selected app, your message and the date and time. For the form for reporting security vulnerabilities we process – on a voluntary basis – name and email address as well as the description of the vulnerability and the affected app. Requests are delivered to us by email via our own mail server at STRATO and used solely to handle them. We keep them until they are resolved and then for no longer than 3 years (limitation period, § 195 BGB).
Legal basis: Art. 6(1)(b) GDPR where your request concerns the use of an app, otherwise Art. 6(1)(f) GDPR.
M.E.L.C. processes all entries (dates, categories, settings) exclusively on your device. For the widget and the Apple Watch app, the data is stored in a protected storage area on the iPhone and synchronised directly between iPhone and Apple Watch. No data is transmitted to us or third parties. You buy the full version via the App Store; Apple is the seller and we do not receive any payment data. Please also note the notes on using M.E.L.C..
With your permission, Train Sounds Effect accesses your music library so that you can play your own tracks, and can import audio files you select into the app's storage. Both happen exclusively on your device; no data is transmitted to us or third parties.
Duke It Out uses our own server for accounts, fights, chat and purchases. Full information is available in the Duke It Out privacy policy.
The FiWo privacy policy applies to FiWo (German only).
The Forgotten X privacy policy applies to Forgotten X.
You have the right of access (Art. 15 GDPR), rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR) and data portability (Art. 20 GDPR), and the right to withdraw consent with effect for the future (Art. 7(3) GDPR).
Right to object (Art. 21 GDPR)
Where we process data on the basis of legitimate interests (Art. 6(1)(f) GDPR), you may object at any time on grounds relating to your particular situation. We will then no longer process the data unless we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.
An informal message to email address (JavaScript required) is sufficient for all of this.
Right to lodge a complaint: You can lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). Transmission between your browser or our apps and our servers is encrypted (HTTPS/TLS). We adapt this privacy policy when our services or the legal situation change. The German version is legally binding.
